    Customer/Access Service Agreement

    This agreement represents the complete agreement and understanding between Go2 The Net, Inc. and the account holder, and supersedes any other written or oral agreement. Upon notice published on-line via Go2 The Net, Inc. service, Go2 The Net, Inc. may modify these terms and conditions, and/or modify prices, as well as discontinue or change services that are offered.

    If you do not agree to these terms and conditions, please notify Go2 The Net, Inc. at (866) 877-4625 so that we may terminate your account.

    Go2 The Net, Inc. will provide Internet-access services to individuals, families, and businesses in exchange for payment of fees and compliance with the terms and conditions of this document.

    Go2 The Net, Inc. Services are defined as provision of access to computing, telecommunications, software, and information services provided by others via the Global Internet. Go2 The Net, Inc. Services include un-metered attended access* to World Wide Web sites and partial access to USENET discussion groups (newsgroups). Some of the discussions may contain language or pictures intended for Adult audiences. Account holders less than 18 years old must have a parent or legal guardian agree to these conditions to indicate acceptance and knowledge of these terms.

    Go2 The Net, Inc. will publish a notice of fee increases/decreases/modifications 30 days before such increases take effect.

    Public Domain materials (e.g., images, text and software programs) may be downloaded or uploaded using Go2 The Net, Inc. services. Account holders may also re-distribute materials in the public domain. The account holder assumes all risks regarding the determination of whether the material is in the public domain.

    As provided by United States federal laws and by International treaties, copyrighted materials (e.g., images, text and programs) may not be uploaded using Go2 The Net, Inc. services without the permission of the copyright holder. Copyrighted material may be downloaded for personal use. Except as expressly permitted, materials under copyright may not be distributed to others. Copyrighted material may not be changed. Neither the author-attribution notices nor the copyright notices be modified.

    Some materials available on the global Internet are called Shareware. These materials may be downloaded and used, but they are copyrighted materials. The copyright holder usually gives permission to use the materials for examination. If you choose to continue using the materials, you are obligated to register your use and to pay a license fee to the copyright holder.

    Go2 The Net, Inc. may terminate any account, without cause or notification to the Subscriber, at any time.

    Go2 The Net, Inc. may terminate sessions at any time, with or without notification to the subscriber, at Go2 The Net, Inc. sole discretion.

    The account holder agrees to maintain a secure password to the account. Secure passwords are those that are between 6 and 8 characters long and contain lower case letters, numbers or other characters. The account holder agrees not to share the password of the account. The account holder acknowledges that Go2 The Net, Inc. will terminate the account without notice if the account holder does not comply.

    Unless otherwise contracted, the account holder is limited to 300 megabytes transfer of data monthly via Go2 The Net, Inc. service.

    Go2 The Net, Inc. provides un-metered attended* access to the Internet. In order to conserve system resources, account holders that are logged in without activity for 20-minute period will be disconnected. Account holders that attempt to "hang" their modems with little activity for long periods of time will receive an Email message discussing their use and asking them to upgrade to a Dedicated Account. While Go2 The Net, Inc. is happy to offer un-metered attended access* time for our subscribers to the Internet, we also need to conserve equipment and modems for use by our entire subscriber base.

    The account holder agrees not to use any process, program, or tool via Go2 The Net, Inc. services for guessing the passwords of account holders on Go2 The Net, Inc. or other systems. The account holder agrees not to use Go2 The Net, Inc. services to make unauthorized attempts to access other systems and Go2 The Net, Inc.The account holder agrees to use the services provided by Go2 The Net, Inc. as permitted by applicable local, state, and federal laws. The account holder agrees, therefore, not to use these services to conduct any business or activity or solicit the performance of any activity that is prohibited by law. This includes but is not limited to transmission or transfer of obscene or pornographic materials or materials protected by trade secret.

    The account holder agrees not to use Go2 The Net, Inc. services to send unsolicited advertising or promotional materials to other network users. An account holder found sending unsolicited advertising in the form of Email messages to other network users will have their account terminated.

    The account holder acknowledges that Go2 The Net, Inc. makes an honest effort to keep information available on Go2 The Net, Inc. systems accurate. However, Go2 The Net, Inc. can make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, or validity for the data and/or information available.

    Use of information obtained from or through Go2 The Net, Inc. is at the sole risk of the account holder.

    The account holder also acknowledges that the information available through interconnecting Go2 The Net, Inc. may not be accurate. Go2 The Net, Inc. has no ability or authority over the material. Go2 The Net, Inc. can make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, or validity of the data and/or information residing on or passing through these Go2 The Net, Inc. Use of information obtained from or through Go2 The Net, Inc. services is at the risk of the account holder.

    The account holder agrees to indemnify and hold Go2 The Net, Inc. harmless from any claims, including attorney's fees, resulting from the account holder receiving Go2 The Net, Inc. services which cause direct or indirect damage to another party.

    Go2 The Net, Inc. accounting cycle begins on the first day of each month. Charges for new accounts are prorated. Charges for terminating accounts are not prorated.

    Account holders will be given access to Go2 The system provided payment is made in advance by credit card, check or cash. All account holders must return a signed Customer Agreement within 10 days of subscribing, or service will be suspended.

    Service payments will be submitted in advance of receiving services. Customers will have the option of having a credit card billed automatically.

    Delinquent accounts are those that remain unpaid at the beginning of the next accounting cycle.

    If notice of dispute as to charges is not received by Go2 The Net, Inc. in writing within thirty (30) days after the billing invoice is issued, the invoice shall be considered correct and binding upon the customer.

    Delinquent accounts shall be terminated on the 5th of the month. Go2 The Net, Inc. reserves the right to pursue all legal remedies available to secure payment of the delinquent amount from the subscriber. Delinquent accounts are subject to interest at the rate of 1 and 1/2% on any unpaid amount, commencing 30 days after the due date. In the event it becomes necessary to enforce collection of an unpaid balance, the customer is responsible for and shall pay Go2 The Net, Inc. all costs of collection, including reasonable attorney's fees and costs.

    There is a service reconnection equal to the currently charged registration fee to remove accounts from suspended status or to reconnect the account holder's service that has been terminated.

    The account holder acknowledges responsibility for the account until payment in full is made.

    Cancellation requests for Go2 The Net, Inc. accounts must be received in writing via Email, fax, or mail at Go2 The Net, Inc. main office. Such requests must be received by 5pm Eastern time on the 25th day of the month in order to be processed by the beginning of the next accounting cycle.

    All Go2 The Net, Inc. accounts must be paid in full before the transaction will be considered complete.

    Any use of Go2 The Net, Inc. system resources that disrupts the normal use of the system for other Go2 The Net, Inc. customers is considered to be abuse of system resources and is grounds for suspension and/or termination of the account.

    Violation of any Go2 The Net, Inc. conditions of use are unethical and may be criminal offenses. You are expected to report to Go2 The Net, Inc. any information you may have concerning instances in which the conditions of use have been or are being violated.

    When Go2 The Net, Inc. becomes aware of possible violations, we will initiate an investigation. At the same time, in order to prevent further possible unauthorized activity, Go2 The Net, Inc. may suspend access to services to the account in question. Confirmation of violations may result in cancellation of the individual account and/or criminal prosecution. The account suspension may be rescinded at Go2 The Net, Inc. discretion, following payment of a reconnection charge.

    If the account holder is dissatisfied with Go2 The Net, Inc. service or with any of its terms, conditions, rules, policies, guidelines or practices, the customer's sole and exclusive remedy is to cancel service with Go2 The Net, Inc..

    Under no circumstances, shall Go2 The Net, Inc. or its employees or contractors involved in creating, producing or distributing Go2 The Net, Inc. service or software be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of or inability to use Go2 The Net, Inc. service including but not limited to the deletion of files or Email, errors, defects, viruses, worms, trojan horses, delays in operation or transmission, or any failure of performance, whether or not limited to acts of God, communications line failure, theft, fire, destruction, breach of contract, negligence, any other cause of action, or unauthorized access to, alteration, or use, of Go2 The Net, Inc. records, programs or services.

    Notwithstanding the foregoing, in no event shall the total liability of Go2 The Net, Inc. or its employees, agents, third party information providers, licensers, contractors and the like, for all damages, losses and causes of action, whether in contract, tort, including negligence either jointly or severally, exceed the aggregated dollar amount paid by the account holder in the month prior to the claimed injury or damage.

    Go2 The Net, Inc. is not responsible for any computer viruses, worms, trojan horses or other computer errors or defects. Go2 The Net, Inc. does not warrant or guarantee that programs or services uploaded or downloaded from Go2 The Net, Inc. services shall be free of all viruses. Any customer found uploading a "virus" will be automatically terminated from the system, and legal action will be pursued.

    Account holder agrees to indemnify and hold Go2 The Net, Inc. harmless against any and all claims arising from account holder's use of Go2 The Net, Inc. services. Account holder shall indemnify Go2 The Net, Inc. against any actions, proceedings, claims or demands in any way connected with Go2 The Net, Inc. service brought or threatened against Go2 The Net, Inc. by a third party.

    Go2 The Net, Inc. shall be indemnified, defended and held harmless by the account holder against all claims, losses or damages arising from the use of Go2 The Net, Inc. service, including but not limited to, the following:

    a) Claims for libel, slander, invasion of privacy, infringement of copyright, or unauthorized use of any trademark, trade name or service mark arising out of the material, data/information, or other content transmitted via Go2 The Net, Inc. service.

    b) Claims for patent infringement arising from combining or using Go2 The Net, Inc. service in connection with facilities or equipment furnished by others.

    c) Violation of anyone's right to privacy.

    d) Violation of any other literary, intellectual, artistic, dramatic, musical right or other content transmitted by Go2 The Net, Inc. service.

    e) Claims related to lost or stolen credit cards, checks, electronic currency or other payment media.

    f) All other claims arising out of any act or omission of others relating to Go2 The Net, Inc. service pursuant to the Customer Agreement. Pursuant to the Electronic Communications Privacy Act of 1986, Title 18, United States Code, Section 2510 and following, notice is hereby given that Go2 The Net, Inc. does not provide by its system for sending and receiving private or confidential messages. The system operator and anyone so designated by the system operator can and may read messages transmitted to or from any account holder.

    Account holder agrees that Go2 The Net, Inc. has the right to monitor Go2 The Net, Inc. services electronically, and to disclose any information as necessary to satisfy any law, regulation, or other governmental request.

    Account holder may not assign or transfer this Customer Agreement.

    This agreement shall be governed and construed in accordance with the laws of the Commonwealth of Kentucky.

    The failure of Go2 The Net, Inc. or the account holder to enforce at any time any of the provisions, rights or options of the Customer Agreement shall in no way be considered to be a waiver of such provisions, rights or options, or in any way affect the validity of the Customer Agreement.

    Account holder shall be deemed to have received notice for purposes of this Customer Agreement and any other policies, upon publication by Go2 The Net, Inc. on Go2 The Net, Inc. website.

    * Go2 The Net, Inc. unmetered attended accounts are not intended as 24 X 7 connections to the internet. If you require a 24 X 7 or dedicated connection, please feel free to call us for pricing.
